Missouri congressional map dispute returns to the U.S. Supreme Court after an Eighth Circuit ruling

Quick Report: Missouri’s congressional map dispute returned to the U.S. Supreme Court through an emergency appeal filed late September 22. The filing followed an Eighth Circuit ruling favoring the state’s 2025 congressional districts. The Supreme Court has given supporters of the newer map until midday September 23 to respond. It has not issued a new ruling on the emergency appeal.

The legal fight over which congressional districts Missouri will use in November is back before the U.S. Supreme Court. The latest emergency appeal was filed after the Eighth U.S. Circuit Court of Appeals ruled in favor of using districts adopted in 2025, despite earlier Supreme Court intervention that left the state using its previous map.

Brownstone Law reported on the Eighth Circuit’s ruling on September 22. At that point, a further Supreme Court filing was possible. The new development is that an emergency appeal has now been filed, requiring the justices to consider the dispute again.

Why Has the Map Returned to the Supreme Court?

The Eighth Circuit directed a federal district court to enter a permanent injunction supporting the use of Missouri’s 2025 map. It delayed the effect of its ruling until September 28 at 5 p.m. Central Time, allowing time for further Supreme Court proceedings. The appeals court concluded that Missouri could not use one congressional map for its August primary and another for the November general election.

The dispute also involves a Missouri Supreme Court decision that prevented the 2025 map from taking effect before voters could decide on it through a statewide referendum. Missouri has since been preparing for the November election under its 2022 districts, and absentee voting is already underway using those boundaries.

What Happens Next?

The U.S. Supreme Court has asked supporters of the 2025 map to respond to the emergency appeal by midday September 23. The filing itself does not change the districts being used for voting, and the Court has not yet decided the latest request. Its next action could determine whether the Eighth Circuit’s ruling takes effect before the November election.

The timing matters because election officials have already begun administering absentee voting under the 2022 map. Any change to the applicable districts would come while voting preparations are in progress.
