Luigi Mangione’s New York murder trial will no longer begin in September after a state judge effectively postponed the proceeding while considering whether the remaining charges should be dismissed.
New York Supreme Court Justice Gregory Carro issued a written order on August 17 giving Manhattan prosecutors until October 9 to respond to Mangione’s double-jeopardy motion. Carro also scheduled Mangione’s next appearance in state court for December 10, 2026, meaning the trial will not proceed on its previously scheduled September 8 start date. Bloomberg Law reported that the trial has effectively been delayed by at least three months.
Mangione, 28, has pleaded not guilty to the remaining New York charges, which include second-degree murder and weapons offenses arising from the December 4, 2024 killing of Brian Thompson in Manhattan.
Why Was Luigi Mangione’s New York Trial Delayed?
The postponement follows Mangione’s August 14 guilty plea in his separate federal criminal case.
After entering guilty pleas to federal stalking charges, Mangione’s attorneys asked Justice Carro to dismiss the New York prosecution. The defense argues that continuing the state case would improperly subject Mangione to another prosecution and punishment based on the same underlying conduct.
Rather than proceeding with jury selection in September, Carro has established a briefing schedule that gives the Manhattan District Attorney’s Office time to respond to the dismissal request.
The district attorney’s office has indicated that it is prepared to litigate the defense motion. No ruling has yet been issued on whether the state charges will be dismissed.
Does Mangione’s Federal Guilty Plea Automatically End the State Case?
No. Mangione’s federal guilty plea does not automatically require dismissal of the separate New York prosecution. His attorneys are asking the state court to apply New York’s protections against successive prosecutions to the circumstances of his case.
The legal question is more complicated than the federal constitutional double-jeopardy rule alone. Federal and state prosecutions are generally permitted under the federal dual-sovereignty doctrine because the state and federal governments are separate sovereigns. New York law, however, contains additional restrictions on successive prosecutions, along with exceptions that may permit a later case where the offenses contain different legal elements or are intended to address substantially different harms.
Justice Carro will therefore have to determine how New York’s rules apply to Mangione’s federal guilty plea to stalking charges and the remaining state murder and weapons charges. The filing of the motion itself does not establish that the state prosecution is barred.
What Charges Does Mangione Still Face in New York?
Mangione continues to face second-degree murder and weapons charges in New York and has pleaded not guilty.
If convicted of second-degree murder in the state case, he could face a sentence of up to 25 years to life in prison, according to reporting on the pending prosecution.
The state charges remain pending unless Justice Carro grants the defense motion or another court ruling changes the status of the case.
What Happens Next in the Luigi Mangione Cases?
The next major step in the state case is the Manhattan District Attorney’s response to Mangione’s dismissal motion, which is due October 9.
Mangione is then scheduled to return to New York state court on December 10. A replacement date for the postponed murder trial has not yet been announced.
His federal case is proceeding separately. Mangione entered his federal guilty plea without a plea agreement, and federal prosecutors have said they intend to seek a life sentence. His federal sentencing is scheduled for December 18, 2026.
For now, the federal case has moved to sentencing, while the state prosecution remains unresolved as Justice Carro considers whether New York’s protections against successive prosecutions affect the remaining murder and weapons charges.
